Interim Measures for the administration of the opening and sharing of major scientific research infrastructure and large scientific research instruments in transportation

Chapter I General Provisions

Article 1 in order to promote the opening and sharing of major scientific research infrastructure and large scientific research instruments in transportation, fully release the service potential and enhance the collaborative innovation ability, These measures are formulated in accordance with the opinions of the State Council on the opening of national major scientific research infrastructure and large scientific research instruments to the society (GF [201, 10 experiments in the same step 4] No. 70), the administrative measures for the opening and sharing of national major scientific research infrastructure and large scientific research instruments (gkfj [2017] No. 289), etc

for scientific instruments and equipment with a single set value of less than 500000 yuan, the management unit shall voluntarily declare, and the Ministry of transport shall select the best to be included in the management

Article 3 the "management unit" mentioned in these Measures refers to the legal entity that manages the scientific research facilities and instruments, including: subordinate scientific research units, universities and industry key scientific research platform supporting units

Article 4 the term "open sharing" as mentioned in these Measures refers to the behavior of management units that, on the basis of meeting the requirements of scientific research and teaching, open and share scientific research facilities and instruments to the society, and provide scientific research and technological development services for other units and individuals (hereinafter referred to as users)

Article 5 the key scientific research platform in the transportation industry, the large-scale instrument and equipment open sharing platform (hereinafter referred to as the open sharing platform) referred to in these measures is a unified portal for the open services of scientific research facilities and instruments, which provides the functions of information integration, display, service, management and evaluation of scientific research facilities and instruments

Article 6 the open sharing platform shall realize docking with the national major scientific research infrastructure and the national network management platform of large scientific research instruments in accordance with relevant requirements

Article 7 in principle, scientific research facilities and instruments invested in whole or in part by financial funds shall be open to the public. If there are other special provisions in laws and regulations, relevant management measures and confidentiality system, their provisions shall prevail. Encourage the scientific research facilities and instruments invested by social funds to be open and shared by the society

Article 8 the opening and sharing of tax-free imported scientific instruments and equipment that are included in the open sharing platform for unified management and enjoy the import tax policy supporting scientific and technological innovation shall be implemented in accordance with the administrative measures for the opening and sharing of tax-free imported scientific instruments and equipment included in the national network management platform (Trial) (gkfj [2018] No. 245) issued by the Ministry of science and technology and the General Administration of customs

Chapter II management responsibilities

Article 9 the Ministry of transport is responsible for managing and guiding the opening and sharing of scientific research facilities and instruments. Its main responsibilities are:

(I) coordinate, promote and supervise the opening and sharing of scientific research facilities and instruments according to the relevant national requirements

(2) formulate policies and measures to improve the opening and sharing of scientific research facilities and instruments

(III) build and manage an open sharing platform

(IV) organize the evaluation and assessment of the implementation of the opening and sharing of scientific research facilities and instruments in accordance with the relevant provisions of the state and the Ministry

Article 10 provincial transportation departments, subordinate units and large transportation enterprises under central management are the assistance management institutions to promote the opening and sharing of scientific research facilities and instruments. Their main responsibilities are:

(I) establish and improve the measures and systems for the opening and sharing of scientific research facilities and instruments

(II) regularly carry out the inspection of the opening and sharing of scientific research facilities and instruments, and track and master the progress of the work

(III) review and publish the shared information of scientific research facilities and instruments according to the classification principle

(IV) according to the requirements of the Ministry of transport, coordinate and organize the evaluation and assessment of the opening and sharing of scientific research facilities and instruments of relevant management units

(I) implement the relevant national and industrial policies and requirements, and formulate the system of opening and sharing of scientific research facilities and instruments of the unit

(II) submit the information of scientific research facilities and instruments of the unit and the open sharing situation to the open sharing platform as required

(III) strengthen the construction of experimental technology team

(IV) cooperate in the open and shared evaluation and assessment work, and accept social supervision

Chapter III open sharing

Article 12 relying on the open sharing platform, the Ministry of transport will work with the management institutions to establish an information exchange mechanism for the open sharing of scientific research facilities and instruments

Article 13 management units shall adopt appropriate methods to implement centralized and intensive management of scientific research facilities and instruments, and promote the open sharing and efficient utilization of scientific research facilities and instruments

Article 14 the management unit shall, within 30 working days from the date of completion of installation, use and acceptance of scientific research facilities and instruments, submit the relevant information of scientific research facilities and instruments that meet the conditions for open sharing to the open sharing platform as required, and release it after being reviewed by the assisting management institution

Article 15 in providing open and shared services, the management unit shall conclude contracts with users to agree on service content, ownership of intellectual property rights, confidentiality requirements, damages, breach of contract, dispute settlement and other matters

Article 16 when using scientific research facilities and instruments to provide open and shared services, management units can charge fees according to the principles of cost compensation and non-profit, and can also agree on the charging standards in a market-oriented manner. The charging standards for open services should be announced to the public through open sharing platforms and other channels. The relevant income of administrative institutions shall be implemented in accordance with the relevant provisions on the income from the paid use of state-owned assets

Article 17 the management unit shall establish perfect records of the operation and opening of scientific research facilities and instruments, and submit relevant information to the open sharing platform every six months as required. The information submission of scientific research institutions and Universities under the Ministry shall be carried out in accordance with the relevant provisions of the state

Article 18 the management unit shall strengthen network protection and data security management in the network environment, and protect the open and shared user identity information of scientific research facilities and instruments, as well as the intellectual property rights and scientific data formed in the process of use

the intellectual property rights formed by users' independent scientific experiments are owned by users independently; For the intellectual property rights formed by the scientific experiments jointly carried out by users and management units, both parties shall agree on the ownership or proportion of intellectual property rights in advance

when publishing works and papers formed by users using scientific research facilities and instruments, they should clearly mark the use of scientific research facilities and instruments

Chapter IV evaluation and assessment

Article 19 the Ministry of transport, together with the administrative agencies, has organized and carried out scientific research and signed supply contracts with RORO, England and SaiFeng, France, respectively, for disc and shaft forgings for aeroengines and aircraft landing gear forgings. The evaluation and assessment of the implementation of facilities and instruments are open and shared, and the evaluation and assessment results are published in appropriate ways. The opening and sharing assessment of scientific research facilities and instruments in subordinate scientific research institutions and universities shall be carried out in accordance with the relevant national requirements. The open and shared assessment of scientific research facilities and instruments of key scientific research platforms in the industry is combined with the regular assessment of key laboratories and R & D centers

Article 20 the evaluation results will serve as an important basis for the construction and configuration of scientific research facilities and instruments. The Ministry of transport will, in combination with the evaluation results and the stock of instrument and equipment assets, carry out weight checking and evaluation on the proposed new facilities and newly purchased instruments of the subordinate units, so as to avoid repeated construction of resources

Article 21 the evaluation results will be applied in the evaluation of key scientific research platforms in the industry. For management units with high use efficiency, significant opening effect and good evaluation and assessment results, the Ministry will notify and praise them in an appropriate manner. For the management units with poor evaluation and assessment results, the Ministry will notify them through the open sharing platform

Article 22 the contents of evaluation and assessment include: the operation of scientific research facilities and instruments, the construction of opening system, service quality, opening effect, information submission, etc. The evaluation and assessment of the opening and sharing of major scientific research facilities shall be carried out with reference to the measures for the administration of national major scientific and technological infrastructure

Article 23 assisting management institutions and management units should strengthen the supervision and management of opening and sharing scientific research facilities and instruments of relevant units to adapt to extensive work

Article 25 the revenue from open and shared services shall be included in the budget of the management unit for unified management. The management unit shall formulate detailed rules or refer to the local policies for implementation

Article 26 management units can focus on key common technologies, cutting-edge leading technologies, modern engineering technologies, and disruptive technology research through the establishment of alliances and other forms of cooperation, concentrate high-quality resources to carry out the open sharing of scientific research facilities and instruments, promote the cross integration of disciplines, and improve the ability of collaborative innovation. Encourage key scientific research platforms in the industry to open and share with key national defense science and technology laboratories, military and military major experimental facilities under the conditions of meeting relevant confidentiality regulations, and improve the military civilian collaborative innovation capability

Article 27 enterprises and social forces are encouraged to participate in the co construction of scientific research facilities and the allocation of scientific research instruments in various ways. The management unit can entrust professional service institutions to undertake the daily management and maintenance of scientific research facilities and instruments, and strengthen socialized services and market-oriented operations

Article 28 of the supplementary provisions of Chapter VI

assisting the management organization may formulate or revise relevant management regulations and implementation rules in accordance with the measures and in combination with the actual situation. The State Railway Administration, the Civil Aviation Administration of China and the state post administration may formulate or revise the administrative measures for the opening and sharing of scientific research facilities and instruments in the fields of railway, civil aviation and postal services.
